Formteknik is part of the MGS Mfg Group Ltd which includes MGS Ireland and US based counterparts in Germantown, Wisconsin, Chihuahua and Juarez in Mexico. This privacy notice will explain how our organisation uses the personal data we collect from you, how we protect it and the choices you can make with respect to it.

Any personal information which you volunteer will be treated with the highest standards of security and confidentiality, strictly in accordance with the Data Protection Acts 1988 and 2003 (as amended) and from 25th of May 2018, the General Data Protection Regulation (the GDPR).

A. What data do we collect?
Formteknik collects the following data:

  • Data relating to correspondence by phone, email or otherwise. We ask that you only disclose information necessary to provide you with our services or to submit a question/query or comment in relation to our services
  • When applying for a vacancy or to work with us. Information provided would include your CV, cover letter, your name, address, email and phone number. CVs would generally include information relevant to your previous employment history, education and interests (degrees, places worked, awards/certificates, contacts of referees). You should not disclose sensitive personal information in your application. Some examples of this might be financial data, religion, medical information and so on.
  • Formteknik as a supplier. Customers supply us with information which may include their employee contact information for the purposes of maintaining business practices. This would normally include email, business address, phone numbers and payment details for invoicing purposes

B. How do we collect your data & how will we use your data?
You directly provide Formteknik with most of the data we collect. We collect data and process data when you:

  • Apply for a vacancy advertised by Formteknik
  • Set up as a vendor of Formteknik or as a client. Formteknik sets your company up as a client on our systems
  • Liaise with us directly about projects that we are undertaking with you
  • Become an active employee of Formteknik and we request specific information from you such as your date of birth, address, contact information and bank account details so that we can create an employee profile for you in our internal HR system and payroll database
    The legal bases for processing of your data are:
  • Processing necessary for the performance with regards any contract which you have entered into and/or prior to entering into with us
  • Processing necessary for compliance with legal obligations to which we are subject
  • Processing necessary for the purposes of the legitimate interests which we pursue in providing services to contract where such interest are not overridden by your interests or fundamental rights or freedoms which require the protection of your information

C. How is your data shared and with whom?
From time to time we will need to share your information with our selected business associates, suppliers and contractors in order to provide you with our services. An example might be our IT service providers, credit reference agencies/banks (where a credit score is a condition of us entering into a contract with you) or with select members of the Formteknik or MGS Group – MGS Mfg Group Ltd for legitimate business interest purposes.

Alongside this, we may need to disclose your personal information to third parties:

  • In order to comply with any legal obligation
  • In order to enforce or apply our terms of us or otherwise to protect our rights, property, safety, our customers or others e.g. exchanging information with other companies/organisations for the purposes of fraud protection/prevention and/or credit risk reduction
  • As part of a project with MGS sites
  • In the event that we sell or buy any business or assets whereby we would be required to disclose your personal data to the prospective seller/buyer
  • If we were to be acquired by a third party whereby information held by us about our customers/staff will be one of the transferred assets

  • The right to rectification – you have the right to request that Formteknik correct any information you believe is inaccurate. You also have the right to request MGS to complete information you believe is incomplete
  • The right to erasure – you have the right to request that Formteknik erase your personal data, under certain conditions
  • The right to restrict processing – you have the right to request that Formteknik restrict the processing of your personal data, under certain conditions
  • The right to object to processing – you have the right to object to Formteknik’s processing of your personal data, under certain conditions
  • The right to data portability – you have the right to request that Formteknik transfer the data that we have collected to another organisation as long it does not result in a disclosure of information relation to other people, or directly to you, under certain conditions

Where our processing of your information is based on your consent to that processing, you have the right to withdraw that consent at any time but any processing that we have carried out before you withdrew your consent remains lawful.

2. Hosting and Content Delivery Networks (CDN)

External Hosting

This website is hosted by an external service provider (host). Personal data collected on this website are stored on the servers of the host. These may include, but are not limited to, IP addresses, contact requests, metadata and communications, contract information, contact information, names, web page access, and other data generated through a web site.

The host is used for the purpose of fulfilling the contract with our potential and existing customers (Art. 6 para. 1 lit. b GDPR) and in the interest of secure, fast and efficient provision of our online services by a professional provider (Art. 6 para. 1 lit. f GDPR).

Our host will only process your data to the extent necessary to fulfil its performance obligations and to follow our instructions with respect to such data.

Execution of a contract data processing agreement

In order to guarantee processing in compliance with data protection regulations, we have concluded an order processing contract with our host.

The data tracked during such analyses are forwarded to Google.

reCAPTCHA analyses run entirely in the background. Website visitors are not alerted that an analysis is underway.

Data are stored and analyzed on the basis of Art. 6 Sect. 1 lit. f GDPR. The website operator has a legitimate interest in the protection of the operator’s websites against abusive automated spying and against SPAM. If a respective declaration of consent has been obtained, the data will be processed exclusively on the basis of Art. 6 Sect. 1 lit. a DGDPR. Any such consent may be revoked at any time.
